“Cease and Desist” Public Notice Against All Forms of Digital Piracy in the Country

The Nigerian Copyright Commission (NCC) recently made public a "Cease and Desist" notice against all forms of Digital Piracy in the Country.

In the notice signed by the Director-General NCC, Mr. Afam Ezekude, all Digital/Internet infringers have been warned to desist from illegal downloading of musical works into devices such as flash drives, hard disks, memory cards and other electronic and computer devices for commercial purposes without due permission from Copyright owners.

The notice further stated that the NCC as the sole agency established under the Copyright Act Cap C28 LFN 2004 is responsible for the enforcement of the copyright legislation in Nigeria, therefore its inspectors are vested with the same powers and rights as other law enforcement agents especially the Police to arrest and prosecute infringers as well as confiscate infringing items.

The general public was reminded by the notice that some raids had earlier been carried out and some infringers arrested for Digital Piracy but were pardoned on the grounds of ignorance but unfortunately the act has continued unabatedly.

The notice, according to the DG, was to again warn that the act is criminal and remains illegal.

He used the medium to inform market leaders, shop owners and landlords to ensure that their members and tenants who are still involved in this illegal business are exposed and handed over to law enforcement agents for appropriate punishments.

The notice further informed that a nation-wide raid against digital pirates and their allies will soon commence and that anyone caught, either as an offender or as aiding and abetting the act, will be prosecuted accordingly.
